 These Terms and Conditions do not create any agency, partnership, joint venture, or employment relationship between you (the customer) and Cohosty.

2. Binding Contract 
 By using our website or placing an order, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions, which form a contractual agreement between you and Cohosty.

3. No Waiver of Rights  
 Failure by Cohosty to enforce any provision of these Terms shall not constitute a waiver of our rights under these Terms or applicable law.

4. Severability 
 If any provision of these Terms is found to be invalid or unenforceable under Scottish law, the remaining provisions shall remain in full force and effect.

5. Third-Party Rights  
 These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

Welcome to Cohosty ("we," "us," or "our"). These Terms and Conditions govern your use of our website www.cohosty.coM and any purchases made from us. By accessing our site and placing an order, you agree to comply with and be bound by these terms in accordance with Scottish law.

1. General Information

  
1.1 Cohosty is a trading name for Capparis Limited, a registered business in Scotland, specializing in the sale of hotel furniture and hospitality products to trade and commercial customers.  
1.2 All product descriptions, images, and specifications are provided for informational purposes. Minor variations may occur.  
1.3 We reserve the right to:  
- Modify prices, product ranges, and terms without prior notice  
- Limit quantities sold to any customer  
- Reject orders at our discretion  

2. Orders & Payment  
2.1 Order Process  
- Orders are binding once payment is received and confirmation is issued  
- We may request additional verification for large/commercial orders  

2.2 Pricing  
- All prices are in GBP (£) and exclude VAT unless stated  
- VAT will be added at checkout where applicable (currently 20%)  
- Prices may change without notice, except for confirmed orders  

2.3 Payment Methods  
We accept:  
- Major credit/debit cards (Visa, Mastercard, American Express)  
- BACS transfer (account details provided on invoice)  
- PayPal (for orders under £5,000)  

2.4 Commercial Accounts 
- Approved trade customers may apply for credit terms (subject to status)  
- Late payments incur interest at 8% above Bank of England base rate

3. Shipping & Delivery 
3.1 Delivery Options  
- Standard delivery: 5-10 working days (UK mainland)  
- Express delivery: 2-3 working days (surcharge applies)  
- Pallet/Courier service for large items  

3.2 Delivery Terms  
- We use third-party carriers; delivery dates are estimates only  
- Someone must be available to accept and inspect delivery  
- Additional charges apply for:  
  - Remote locations (Scottish Highlands & Islands)  
  - Failed deliveries requiring redelivery  
  - Special handling requirements  

3.3 Risk & Ownership  
- Risk passes to buyer upon delivery  
- Ownership remains with Cohosty until full payment is received  

4. Returns & Refunds 
4.1 Standard Returns  
- 14-day return period for unused goods in original condition  
- Buyer pays return shipping unless item is faulty  
- Refund issued within 14 days of receipt  

4.2 Faulty Goods  
- Report defects within 7 days of delivery  
- We will arrange collection and replacement/refund  

4.3 Non-Returnable Items  
- Custom/made-to-order products  
- Items specially sourced for customer  
- Hygiene-sensitive products (mattresses, pillows) 

5. Warranties & Liability  
5.1 Product Warranties  
- Standard manufacturer warranties apply (typically 12 months)  
- Extended warranties available for certain products  

5.2 Limitation of Liability  
- Our maximum liability is limited to the purchase price  
- We are not liable for:  
  - Consequential or indirect losses  
  - Improper installation or use  
  - Modifications made to products  

5.3 Force Majeure  
We are not liable for delays/cancellations due to:  
- Natural disasters  
- Industrial action  
- Supplier failures  
- Government actions  

 

6. Intellectual Property  
6.1 All website content, designs, and branding remain our exclusive property  
6.2 Unauthorised use may result in legal action under the Copyright, Designs and Patents Act 1988
